1. General

These terms and conditions regulate participation in the competition on the "Athletic Day" on June 1, 2024, by to the top sportswear GmbH, to the top sportswear GmbH, Schöneberger Ufer 55, D-10785 Berlin (hereinafter referred to as the organizer).

2nd group of participants

All persons who visit the organizer's stand at the "Athletic Day" between June 1st, 2024 and June 1st, 2024 are eligible to participate. All employees of the organizer, their relatives or employees of cooperation partners who are involved in the competition are excluded from participation. Participation in the competition does not oblige you to purchase goods or services from the organizer.

3. Procedure of the competition

The competition will take place exclusively on June 1, 2024, from 10 a.m. to 6 p.m. Participation in the competition is free of charge and independent of whether the participants are customers of the organizer.

Participants must register for the newsletter at https://to-the-top.com/gewinnspiel and confirm the two-step registration on site. Upon presentation of the final registration email, participants will be given a key that was randomly selected beforehand. With the randomly selected key, participants will be given the opportunity to open the doors (four in total) of a metal locker. Each door hides a prize. If the drawn key opens a door, the participant can keep the prizes hidden behind that door.

A key may be drawn once per newsletter registration.

The following prizes can be won:

• Seamless wear set, consisting of: 1x sports bra, 1x long sleeve, 1x sports leggings

• 10% discount voucher

• 20% discount voucher
• 25% discount voucher

4. Participation

In order to take part in the competition, you must register for the organizer's newsletter. This requires filling out the following contact details on https://to-the-top.com: name, email address. Registration is only complete when the automatically sent confirmation email has been accepted. Participation in the competition can then take place when the final confirmation email is shown at the stand.
Participation by any other means is not permitted. If the contact details provided are incorrect (incorrect email address), the organizer is not obliged to accept participation in the competition.
Participation in the trade fair competition of “to the top sportswear GmbH” is free of charge and is governed exclusively by these terms and conditions.
Any possible disadvantages resulting from providing incorrect contact details are at the participant’s expense.
Each participant may only take part once, providing their contact details. The prerequisite for participation is signing up for the newsletter and showing the registration. The confirmation email is used to verify this. Participation via competition agencies is prohibited, as is multiple participation by a participant with multiple email addresses in order to increase their chances.
The organizer is entitled to exclude individual persons from participation, e.g. in the event of violations of the aforementioned conditions, in the event of false or misleading information in connection with participation in the competition or in the event of a proven attempt to manipulate the competition or in the event of manipulation having taken place.

5. Warranty

The organizer cannot guarantee the availability of the competition at the KAIFU Lodge Athletic Day. The competition can be terminated due to external circumstances without the participant being able to draw any conclusions from this.

6. Determination of profit

The prize for each participant will be determined by drawing a key at random. If the participant waives the prize, the next participant will not receive the prize.
The prize will be accepted by the participants on site. If the respective participant does not confirm acceptance of the prize within 10 minutes on site, the prize will be forfeited.
It is not possible to pay out a prize in cash or exchange the prize; the prize cannot be transferred to third parties.
The prize will only be handed over to the winner. The prize cannot be exchanged or paid out in cash. Non-cash prizes will be handed over to the winner personally.
The winner is responsible for any taxation of the prize.

7. Termination of the competition

The organizer expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to adapt these conditions of participation.

8. Liability and legal recourse

The competition is subject exclusively to the laws of the Federal Republic of Germany. Legal recourse is excluded.

9. Information Privacy Policy

The participant's contact details such as first name, last name and email address are collected, processed and used to conduct the competition within the framework of the legal requirements. The data of the participants in the competition will be stored indefinitely after the competition has been carried out in order to send them the newsletter. You can unsubscribe at any time. The organizer is not liable for damages caused by errors, delays or interruptions in transmission, malfunctions in technical systems and services, incorrect content, loss or deletion of data, viruses or in any other way when participating in the competition, unless such damages were caused intentionally or through gross negligence by the organizer (its bodies, employees or vicarious agents). The above limitation of liability does not apply in the event of injury to life, body or health or in the event of fraudulently concealed defects.
In order to take part in the competition, you must provide personal data. The participant assures that the personal information he or she provides, in particular first name, last name and email address, is true and correct.
The collection and processing of personal data serves exclusively to carry out the competition, to determine the winners and to send the prize.
Participants’ personal data will not be passed on to third parties or made available for use without their consent.
The participant can obtain information about his data stored by the organizer at any time, object to the use of his data and request its deletion. To do so, a simple

10. Severability Clause

Should a provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. Instead of the invalid provision, the legally permissible provision shall apply which economically comes closest to the meaning and purpose expressed in the invalid provision. The same applies if there is a gap in the provisions of these terms and conditions of participation.
